Payment Policy:
After customer has been invoiced, we require 30-90 business days to prepare your equipment, depending on the equipment piece and refurbishing process, some items do not apply and ship immediately, please see official invoice. Custom frame and upholstery colors may take up to four weeks to complete. You will be notified when your product is ready for shipment. Ultimate Rope Climber charges $25.00 for customer checks returned for any reason.

Cancellations:
All cancellations prior to shipment or delivery of your equipment must be in writing. Canceling your order after your product has shipped will result in the forfeiture of your shipping charges. In the event that the buyer/seller must commence action to recover any sums on the invoice or dispute their order, it is agree that such action can be brought in the courts. Buyer agrees to pay reasonable attorney’s fees and cost of the suit.

Refunds:
Ultimate Rope Climber offers a 30 day 100% money back guarantee on merchandise deemed defective on arrival or unserviceable by Ultimate Rope Climber or an authorized service provider of said corporation. Ultimate Rope Climber will arrange to send a technician to location to evaluate the product. Customer can return product at Ultimate Rope Climber’s expense if the wrong product has been accidently received. Ultimate Rope Climber will pay to pick up the incorrect product and will immediately commence the process of shipping the correct one. If the customer decides to return the goods for any reason other than craftsmanship or error on Ultimate Rope Climber’s part, customer is responsible for all shipping charges back to origin.

Liabilities:
Ultimate Rope Climber has no control over customer’s use or operation of their equipment; customer therefore assumes all responsibilities and risks associated with the equipment’s use and operations. Customer agrees to indemnify and hold Ultimate Rope Climber harmless from any claims, demands, cause of action, damages, losses, costs, attorney fees or expenses which may arise out of any injury from use of the equipment or dispute with the manufacturer regarding construction and/or operation of the equipment; as well as the customer’s or any third party’s use or inability to use the equipment.

Shipping:
The equipment is sold on a “cost & freight” basis and Ultimate Rope Climber will arrange shipment. Ultimate Rope Climber shall not be held liable or responsible for any damages that may occur to the equipment after it has been shipped from Ultimate Rope Climber’s premises. The customer must note any visible damage on the bill of lading or air bill. If you experience any problems when receiving your product, like damage in shipping, always accept the shipment and mark it damaged. Ultimate Rope Climber will assist customer in filing claims against the shipper and/or sending a replacement unit if it is unserviceable onsite.

Ultimate Rope Climber does not guarantee delivery by a specific date and customer acknowledges that any proposed date provided by said corporation shall only be an estimated date. Shipping charges do not include inside delivery or setup, unless otherwise specified in writing on invoice. All products ship curbside, unless otherwise stated on invoice. Additional fees apply to services such as “inside delivery” and “lift gate.”

Warranty:
(a) “As is” sale. The equipment is sold “as is” and “where is” without any express or implied warranties, except that the equipment is free and clear of any liens or encumbrances. ULTIMATE ROPE CLIMBER MAKES NO WARRANTY, EXPRESS OR IMPLIED, REGARDING THE EQUIPMENT AND DISCLAIMS ANY WARRANTY OF MERCHANTABILITY OR WARRANTY OF FITNESS FOR ANY PARTICULAR PURPOSE. IN NO EVENT SHALL ULTIMATE ROPE CLIMBER BE LIABLE TO CUSTOMER OR ANY THIRD PARTY FOR ANY DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO BODILY INJURY, PROPERTY DAMAGES, LOST PROFITS, LOST SAVINGS OR OTHER INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE SALE, USE OR INABILITY TO USE THE EQUIPMENT.

(b) Limited 5 Year Warranty: Ultimate Rope Climber warrants that the product you have purchased for use from Ultimate Rope Climber or from an authorized Ultimate Rope Climber reseller is free from defects in material or workmanship under normal use during the warranty period. Ultimate Rope Climber hereby provides customer a one year warranty on parts and a ninety day warranty on labor on all refurbished/remanufactured cardio and strength equipment, unless otherwise stated on invoice; the warranty shall commence of the date Ultimate Rope Climber ships and/or delivers the equipment to customer. Your sales receipt, showing the date of purchase of the product, is your proof of purchase. This warranty only extends to you, the original purchaser. It is not transferable to anyone who subsequently purchases the product from you. During the warranty period Ultimate Rope Climber will repair or replace (at Ultimate Rope Climber’s option) the product if it becomes defective, malfunctions, or otherwise fails to conform to this limited warranty under normal use. In repairing the product, Ultimate Rope Climber may replace defective parts, or at the option of Ultimate Rope Climber, serviceable used parts that are equivalent to new parts in performance. All exchanged parts and products replaced under this warranty will become property of Ultimate Rope Climber.
